Overview
The General Accounting Office (GAO) recently announced that the number of bid protests filed in 2008 represented a ten year high in terms of protest frequency. And although the rate of successful or sustained protests dipped slightly in 2008, more than 20% of all protest filed in 2008 were sustained, resulting in a range of remedies from new procurements to re-opened award decisions. Overall, more than 40% of all protests filed in 2008 resulted in some form of corrective action being taken by the buying agency. This trend has significant implications for both procuring agencies and vendors alike.

Jim Phillips and Brian Caney are experienced federal contracts attorneys and policy experts that advise private sector and public sector clients alike on bid protest issues. Over the past twenty five years Mr. Phillips has successfully represented private sector clients in numerous bid protest proceedings before both GAO and the Court of Federal Claims (CoFC). He also assists federal agencies to plan and execute procurements so as to minimize the potential for successful protests. Mr. Caney regularly represents contractors in prosecuting and defending protests before GAO and the CoFC.
